To further help businesses mitigate the impact of the COVID-19 pandemic, ZATCA has prolonged the tax-related exemption from wide scale of penalties and fines for an additional 6 months.
As we wrote in a previous update, earlier in June this year ZATCA announced an initiative to suspend fines and penalties for taxpayers subject to all tax laws in the KingdomZATCA announced an initiative to suspend fines and penalties for taxpayers subject to all tax laws in the Kingdom earlier in June this year. The initiative was effective from the beginning of June 2022 until the end of November this year.Yesterday, the ZATCA announced a re-scheduling of the timelines – the exemption extension will further be applied, starting from 1 December 2022 until 31 May 2023.Moreover, ZATCA emphasized that the fines enclosed in the initiative include, among others, registration in all tax systems, late payments, and late submission of a declaration in all tax systems. Penalties for field violations related to the application of electronic invoicing rules and provisions are listed as well.In tandem with the announcement, ZATCA published an updated guideline that includes a detailed clarification of the scope and the applicability of the exemptions with various illustrative examples.
Read More →To ensure a successful implementation of e-invoicing requirements and to support the targeted taxpayers, ZATCA has initiated subsidizing e-invoicing solutions acquired by taxpayers and purchased after 4 December 2020 for VAT-registered taxpayers with an annual turnover of less than SAR 3 million (ca. EUR 800 000).
To get the compensation, taxpayers can apply by filling in the “E-invoicing Subsidy Request” form available on the taxpayer portal and provide the following details:
1. Invoice reference number, purchase date, and the total amount for the purchased solution;
2. Name of the purchased solution’s service provider;
3. Sample of an invoice issued by the e-invoicing solution in use.
After successfully submitting the subsidy form, taxpayers should wait for a reply from ZATCA on the estimated financial support they will receive.
E-invoicing continues to make strides in Saudi Arabia. In a significant step towards digital transformation in the region, ZATCA has recently launched several important updates for taxpayers.
After concluding the public consultation on 10 June 2022, the Zakat, Tax and Customs Authority (ZATCA) approved the proposed amendments to the earlier released e-invoicing rules and regulations issued on 4 December 2020 and published the latest versions on 24 June 2022.Furthermore, ZATCA released a new Fatoora portal dedicated to issuing digital certificates and signatures to integrate with the mandatory infrastructure. A corresponding detailed guide on how to use it has also been published.Finally, on 29 June 2022, ZATCA published a new E-invoicing Detailed Technical Guideline. This guideline will help taxpayers prepare for successful onboarding of the E-invoice Generation Solution Units and fulfil and monitor their compliance with the Phase 2 e-invoicing requirements.

For Phase 1 (December 4, 2021), format of the E-invoices is similar to that of current tax invoices, with some additional fields -
1. For Simplified tax invoices (issued for B2C transactions) - Mandatory to add QR codes
2. For Tax invoices (issued for B2B transactions) - Mandatory to add VAT number of buyer if the buyer is a registered VAT payer and Optional to add QR code No specific file format has been specified for Phase 1, but they must be issued from an electronic system meeting ZATCA’s requirements. Also, electronic copies of all invoices must be stored by the taxpayer.

E-invoicing (FATOORAH) applies to all persons registered under VAT and any other parties issuing tax invoices on behalf of suppliers subject to VAT. Currently, taxable persons who are non-residents of KSA are excluded from E-invoicing requirements.

The technical requirements are typically implemented by solution providers (like Cleartax) or the internal technical teams for in-house built solutions. Taxpayers can approach us to update to a compliant electronic system and make sure that you are generating compliant invoices starting from December 4, 2021.

E-invoices shall be issued for all tax invoices including export sales and other zero-rated supplies. Credits and debit notes should also be provided electronically. E-invoicing is not applicable for Exempt supplies, Import of goods and Supplies under reverse charge mechanism.

Yes, QR codes are mandatory for simplified tax invoices (issued for B2C transactions) and optionally for tax invoices (issued for B2B transactions). QR code is not provided by ZATCA and shall be generated by the Cleartax E-invoicing software.
E-invoicing (FATOORAH) will be implemented in two phases :
Phase 1 (Generation Phase) - Applicable form December 4, 2021
Phase 2 (Integration Phase) - Applicable starting from January 1, 2023 and implemented in waves. Date of integration will be notified ZATCA at least 6 months in advance.
